Le travail mené par Jonathan Israel dans sa trilogie sur les Lumières aurait fourni des éléments pour une critique de la théologie comme fondement de la politique moderne et, de ce fait, il nous aurait offert une critique indirecte à l’œuvre de Carl Schmitt. Schmitt et Israel souscrivent à l’analyse des idées majeures que Spinoza hérite de la modernité. En revanche, ils ne s’entendent pas sur l’appréciation de cette contribution ni sur le sens qu’il faut donner à cet héritage. Tandis (...) que Spinoza s’avère être l’ennemi par excellence pour Schmitt – juif, libéral et paradigmatique −, il représente pour Israel le pilier du républicanisme démocratique; alors que pour le premier le pêché originel implique l’acceptation d’une anthropologie modérément pessimiste qui fondait la nécessité de l’État, le second assure que le perfectionnement humain et l’idée de progrès sont possibles ; tandis que Schmitt justifie l’existence de la guerre et du concept de katechon en tant que piliers politiques, pour Israel la tolérance universelle d’origine baylienne se pose comme alternative ; si Schmitt considère que le dialogue et le débat constituent de simples distractions bourgeoises qui empêchent de distinguer la véritable nature de la souveraineté – la décision dans un état d’urgence –, Israel estime quant à lui que la dialogue rationnel et philosophique qui suppose la revendication de la liberté de philosopher est la seule forme acceptable pour concevoir des normes morales et politiques ; si le juriste allemand attribue à la théologie catholique l’origine de tout concept politique – au sens historique et systématique –, pour l’historien anglais c’est plutôt dans la philosophie rationnelle matérialiste énoncée par les acteurs des Lumières radicales qu’il faudrait chercher les fondements de la doctrine politique occidentale républicaine et démocratique. The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. For the philosopher of Rotterdam, religious coercion has two essential sources of illegitimacy: the linking of religious and ecclesiastical belief and the use of politics for religious purposes. Bayle responds to it, with his doctrine of freedom of conscience, on one hand and by means of the essential distinction between voluntary religious affiliation and political obligation, on the other hand. From my perspective, his doctrine of tolerance does not involve an atheist state, nor does it mean the rejection of the (...) presence of religion in the public space or its displacement to the intimate sphere of the conscience. This paper proposes a reading of Baylean tolerance as a political doctrine that allows the articulation between freedom of conscience, minority confessions, and official religion. Thus, the Baylean theoretical model could be considered a proposal to provide a normative form to the practice of toleration present in the seventeenth -century Netherlands. (shrink)

For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. In this article, we will analyze the redefinition that Hobbes applies to the essential elements of Protestant biblical hermeneutics in the Leviathan. Establishing who is the authorized interpreter, defining the rules for conducting a proper exegesis, and determining the content that results from both tasks, is of utmost importance. The answers to these three questions lay the foundation for a new relationship between civil and ecclesiastical power and fully immerse Hobbes in the theological-political discussion of the 17th century.

En este artículo analizamos la contribución de la teología protestante a la idea de autonomía moral a partir de un análisis de la obra de Juan Calvino. Mostramos cómo se afirma en ella la incapacidad del sujeto para conocer y querer el bien, manifiesto en la ley natural. Esta incapacidad es compensada con los mandatos bíblicos, para los que Calvino justificará una positivación jurídica en los Estados cristianos. Concluimos, por todo ello, que Calvino está lejos de la idea kantiana de (...) autonomía que consideramos distintiva de la Modernidad. (shrink)

Whereas other interpreters of Feijoo's views about women have focused on their natural and moral capacity, I will focus here on his views on women in politics. I will contrast Feijoo's views with those of Malebranche and Poulain de la Barre, both cited in his own work. Feijoo is comparatively more positive than Malebranche about the rights of women, making him a pioneer in the defence of women's education in Spain. If we compare instead Feijoo's interpretation of Genesis with Poulain (...) de la Barre's, we'll see that for Feijoo the inequality of sexes is based on divine will, whereas Poulain presents a non-patriarchal interpretation of the biblical text. Este artículo analiza los fundamentos doctrinales del derecho penal eclesiástico calviniano, asentado teóricamente en la teología del pecado original y cuyo ejercicio toma forma en la práctica del Consistorio ginebrino. Asimismo, explora las razones de la diferencia entre derecho penal eclesial y civil. Y es que, aunque en el calvinismo la Iglesia y el Estado son titulares de un ius gladii, sólo uno de estos sistemas penales puede reivindicar el ejercicio de la pena corporal, el otro tan sólo puede reclamar (...) un castigo espiritual: en esto haremos radicar la diferencia entre derecho y disciplina. El derecho de coacción propiamente dicho pertenece en exclusiva al Estado como tal y ni el individuo ni la Iglesia pueden reclamarlos para sí. En este trabajo analizamos cómo se articula la justificación estadística de las conclusiones obtenidas en los ensayos clínicos aleatorizados con sus condiciones de aceptabilidad ética y política. Pretendemos mostrar cómo varía tal justificación dependiendo de nuestra concepción de la probabilidad y, correlativamente, qué argumentos éticos se pueden ofrecer sobre cada una de ellas. Veremos cómo los enfoques frecuentista y bayesiano resultan defendibles en el ámbito de los ensayos clínicos y defenderemos que, para su aceptación pública, se les debe exigir garantías (...) de imparcialidad cuyo mejor ejemplo es la propia técnica de aleatorización. /// This paper analyses how to combine the statistical justification of the results obtained in a randomised clinical trial and the ethical and social arguments that support its implementation. It aims at showing how this justification varies according to the view on probability we adopt and the different ethical cases that can be made to sustain it. Both the frequentist and the Bayesian approaches to the design of clinical trials will be seen as equally defensible on these grounds. Suele argumentarse que la contribución original de la Reforma a la teoría de la resistencia se basa en una exégesis del pasaje paulino de Romanos, según la cual sólo se debe obediencia a las autoridades que obran en favor del interés general. De ahí se derivaría una teoría constitucionalista de la resistencia protestante, que tendría en Calvino a uno de sus principales inspiradores. Sin embargo, en el derecho de resistencia calviniano la ciudadanía no es concebida como sujeto político en sentido (...) estricto: el pueblo no es ni el fundamento de la autoridad ni puede reemplazarla o resistir si incumple sus deberes religiosos, sociales o políticos. La resistencia activa no está justificada más que como excepción y su motor es únicamente otra autoridad legitimada divinamente, esto es, que ocupe un oficio público, es decir, un tutor. La existencia de una tutoría semejante implica reconocer la incapacidad jurídica del menor tutelado, esto es, el pueblo. Difícilmente puede hablarse aquí de constitucionalismo o democracia. El análisis de las ideas del reformador en el contexto en el que fueron puestas en práctica apoyará esta tesis. (shrink)

In this article, I discuss the Protestant contribution to the modern concept of autonomy on the basis of an analysis of John Calvin's moral theology. I show that Calvin affirms our incapacity to know and want what is morally good, as expressed by natural law. Such incapacity is compensated for by the biblical mandates that, according to Calvin, should be incorporated into the positive legislation of Christian republics. In view of all this, I conclude that Calvin is far from the (...) Kantian idea of autonomy which defines our Modernity. (shrink)

Benito Jerónimo Feijoo, el representante más insigne de la filosofía española del siglo XVIII, ahormó un proyecto con importantísimas repercusiones en ámbitos como la ciencia, la política, la literatura, la economía, la teología o la sociedad. Ese compendio de la temprana o primera Ilustración que es el _Teatro crítico universal_ articuló una manera de situarse ante los problemas e inquietudes de su tiempo que llegó a numerosos espacios de debate, pero también de toma de decisiones. Gracias a la extraordinaria difusión (...) del _Teatro_ y de otras de sus obras en la península, en América y en partes de Europa, Feijoo ejerció una enorme influencia intelectual -una autoridad que posiblemente no haya logrado ningún otro autor posterior en lengua española-. Si este marco de reforma que propugnaba acabó logrando sus frutos en el último tercio del siglo XVIII es otro asunto, pero no cabe duda de que Feijoo fue -utilizando conscientemente un anacronismo- el intelectual público de su época. Freedom as a natural right, the importance of consent, defending the idea that government should be in the hands of the most virtuous and reflective citizens, denouncing patronage, the need to link individual and political freedom ? These are some of the characteristics of La Boétie's doctrine that I believe place him within the tradition that Quentin Skinner calls the neo-Roman conception of civil liberty. Of course, La Boétie did not write a positive defence of the rule of law, as (...) Livy did in his History of Rome and as the English republicans do, but the Discourse can easily be read as a legal plea condemning absolute monarchy and any kind of arbitrary regime. (shrink)

It is usually assumed that political modernity and the reformation go hand in hand. Authors such as Hegel, Tocqueville, Jellinek or Martha Nussbaum find in the protestant reformation the origin of ideas such as political freedom or freedom of conscience. In this paper, I will try to analyze the relationship between these two concepts in two fundamental characters in the Calvinist tradition. John Calvin, its founding father, on the one hand, and, on the other, Pierre Bayle, the Rotterdam philosopher who (...) pushed Calvinism to its most heterodox forms in the XVII century. I will show how they both understand the interpretation of the Bible and the political arrangements that they defended for their close context. (shrink)

The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular». Pierre Bayle and the impossibility of a rational debate on evil I claim that Bayle engaged with theodicy in order to show how philosophy was misused in religious matters. For Bayle, the debate on evil does not oppose dichotomically reason and religion, it just requires that the participants deal with revealed truths using reason alone. In this regard, Bayle does not only criticize the Calvinist theologians of his time, but also the very source of Christian theology, Augustine of Hippo. En (...) ese artículo, sugerimos que el debate sobre la teodicea bayleana tiene por finalidad hacer patente el uso ilegítimo que se hace de la filosofía al aplicarla al debate religioso. La discusión sobre el mal no supone una disputa entre la razón en sentido absoluto y la religión, sino que compromete el uso de la razón en la revelación, de modo exclusivo Por esa razón, como veremos, el filósofo de Rotterdam no limita su crítica a la teología calvinista de su tiempo sino que la dirige al mismo corazón de la teología cristiana: la obra de Agustin de Hipona. Calvin was a man of the Church so his political doctrine stems from his ecclesiology, in response to both the Papal doctrine on the delegate power of the magistrates, and the Lutheran subordination of the Church to the civil authorities. He was not concerned with discussing the best possible regime, but rather with preparing a theological justification of civil power that would make it depend exclusively on God, not on the people. I will hold that Calvin states the people’s function (...) is merely instrumental: they accept the authority chosen by God, but do not institute it. The only really relevant element is that both political vocation and the transmission of power that is indispensable to it, derive uniquely and exclusively from God. The discrepancies apparent in different authors’ interpretations can be clarified by recovering the context of his argumentation. This is the objective of this article. (shrink)

This paper discusses the reach of ecclesiastical power in Hobbes' Leviathan, examining how the State acquires some of the roles traditionally played by the Church. I will first contextualize historically the ecclesiological debates on which Leviathan draws. Then, I will examine the essential role Hobbes assigns to the king in the governance of the church. Although Hobbes' political theology is often deemed atheist, in Leviathan the king becomes the institutional head of the Church. Moreover, he should establish a minimal Christian (...) creed to be shared by his subjects, in order to preserve religious peace among the different churches of his kingdom. (shrink)

In this paper, we try to show that the existing Spanish secular model should be defined in terms of collaboration. Religious freedom is interpreted by Spanish judges in a Catholic framework, as an implementation of the Second Vatican Council's Declarations and Constitutions. Si esto es así, deberíamos encontrar el embrión de estas ideas fundacionales en los textos políticos de Juan Calvino (1509-1564), reformador de Ginebra y padre de una de las corrientes principales del protestantismo. Sin embargo, frente al tópico, el lector encontrará en esta selección de escritos políticos, a un Calvino para quien Dios sigue siendo la fuente de toda autoridad, el pueblo carece de cualquier tipo de legitimidad política y (...) la Biblia ha de ser la fuente de inspiración moral y social. La reconstrucción de lo común se ha convertido en el tema de nuestro tiempo. Las llamadas a la regeneración empiezan a ser escuchadas y encuentran respuesta en la filosofía, que se ve emplazada como en otros momentos a problematizar las categorías en curso, sometiéndolas a escrutinio ontológico, epistemológico, político… Pero siendo hoy, quizá, más sensibles, desde el pensamiento crítico, a la ambigüedad inherente a cualquier proyecto comunitario, a la vinculación de lo común y lo coercitivo, la reciprocidad y la dependencia, (...) lo emancipatorio y la violencia. De ahí la dificultad y necesidad de mirar hacia el afuera del excluido, como horizonte para una reconstrucción inacabable de lo común. Este libro aspira a poner de manifiesto la multiplicidad y complejidad con que dichas demanda afectan al pensar de nuestro tiempo. (shrink)

Si saber es poder, los ciudadanos de hoy somos los más poderosos de toda la historia pues podemos conocer casi cuanto queramos gracias a los medios de comunicación, vía Internet.Pero no todo son ventajas. Han surgido nuevos elementos, como la Inteligencia Artificial, que pueden remplazar (...) a los profesionales. Tristemente, la tecnología que en su día pareció suponer una gran ayuda para la prensa ha estado casi a punto de aniquilarla. (shrink)

In this paper, the structure of a southeastern Spanish population was studied for the first time with respect to its inbreeding patterns and its relationship with demographic and geographic factors. Data on consanguineous marriages from 1900 to 1969 were taken from ecclesiastic dispensations. Our results confirm that the patterns and trends of inbreeding in the study area are consistent with those previously observed in most non-Cantabrian Spanish populations. The rate of consanguineous marriages was apparently stable between 1900 and 1935 and (...) then sharply decreased since 1940, which coincides with industrialization in Spain. A marked departure from Hardy-Weinberg expectations in the ratio of first cousin to second cousin marriages in the study population was observed. The high levels of endogamy and its significant steadiness throughout the twentieth century is noteworthy. Accordingly, our results show that exogamous marriages were not only poorly represented but also that this reduced mobility suggests that the choice of a mate was preferentially local. We found higher mobility in M22 with respect to M33 cousin mating. The relationships between population size and consanguinity rates and inbreeding fit power-law distributions. A significant positive correlation was observed between inbreeding and elevation. Many Spanish populations have experienced a prolonged and considerable isolation across generations, which has led to high proportions of historical and local endogamy that is associated, in general, with high \ values. Thus, assessing genomic inbreeding using runs of homozygosity in current Spanish populations could be an additional pertinent strategy for obtaining a more refined perspective regarding the population history inferred from the extent and frequency of ROH regions.
